To begin the process, the first thing you need to do is find an Experienced Attorney that does Expungements.

  • For Misdemeanors, there is a waiting period of one (1) year after a Deferred Sentence has been fulfilled.
  • For Felonies, there is a waiting period of five (5) years after a Deferred Sentence has been fulfilled.
It takes between 45 - 60 days to do an Expungement.  To begin the process, a Motion has to be filed in the District Court with a Hearing date before a Judge.  After a successful Expungement Hearing and no objections, the Police Department, District Attorney, Court Clerk, OSBI and OSCN will be notified with a certified copy of the Order to Expunge the case as if it never happened.    Wipe the slate clean today with an Expungement!
