A man was arrested on Tuesday October 29 for apparently raping his wife. Police reports show that Francisco Ortiz Martinez, age 53, grabbed his wife against her will. They were in their Phoenix home on August 25.
At around 3:00 PM Martinez grabbed his wife and dragged her back to the master bedroom of the home that they had shared together. According to reports, Martinez covered her mouth over so that she could not scream. He then forced her onto the bed and started to rip off the pants that she was wearing.
Once he had done that, he ripped off her underwear in turn. Martinez then had sex with her against his will, according to these same reports. After the coerced sex act had taken place, she put on her clothes. She then ran out of the house.
Investigators are not sure of when the woman contacted authorities. However, she submitted herself to a sexual assault examination. She also called her husband while police officers listened in.
During the confrontation call, Martinez admitted that her accounts of incident were indeed correct. Then at 1:30 PM on October 29, Phoenix police went to the home. When they arrested Martinez, he reportedly made several other admissions somehow relating to the sexual assault of his wife.
Legal analysts actually believe that it would have been extremely difficult to make a case against him without those admissions. The fact that he made them personally, however, makes developing a case against him easier. Family court records actually indicate that the couple does not have children. His wife filed for divorce a month before the attack occurred.
Martinez was booked into jail on the suspicion of sexual assault as well as on the suspicion of kidnapping. Both of these are Class 2 felonies, but there is no indication as to whether or not he has been charged yet.
Martinez and his wife have been living in that home for five years. They apparently have had other domestic violence issues in the past before this happened.
