Cross-Examination: West walks the doc through the autopsy again. Wants rolls of assistants, who cut, who wrote. One with clean hands takes dictation during the autopsy. First, overall exam. No plastic bags on hands of Trayvon Martin to prevent wiping off of blood. W says no plastic bags on hands like on TV, but use paper bags only. But not done at scene to preserve integrity of evidence on hands. Body was at scene for three hours in the rain before transported to him. It's in his investigator's notes. Don West halts him from blabbing on. His assistant arrived at crime scene at 2144. Now he erupts again. "I'm under oath, understand, I must read thee notes to you.
NO. Answer questions. OK
Q: Assume incident was 1915.
A: You can't ask me yes or no question.
Q: Again, what time did your investigator arrived at scene and she left 2210.
A: I will say OK but not yes or no. Perjury, Finally, investigator was there hours? Yes.
Q; Was body was exposed to the elements?
A: " I wasn't there."
Q: Didn't you review notes before autopsy?
A: "All I know is he is shot and dead."
Q: So you did autopsy without reviewing notes?
A: "I have no memory of this autopsy and can't testify without notes." Then he launches again..." I need to explain to jury why I can't remember" and he goes on and on again.
Q: Can the court tell him to shut up? He won't shut up. " I can't remember and have to rely on notes and photos." OK
Q: Generally when do you see body?
A: Conference in AM and then autopsy. Then blah blah blah.
Court: Wait for a question and answer it !!! Ok.
Q: In report " body is viewed unclothed." Did you open the bag and removed the clothes and report starts there? Body removed from bag?
A: No, bag removed from body. Clothing removed by assistant. Did you witness clothing removed? "I was there, not fact, opinion that I was there." Protocol was that clothing was put in paper bags,
Q: Do you know that?
A: Should be. If wet, we let dry and package in paper. I can't tell you anything from memory. Violation of protocol to pack wet shirts in plastic. If anyone did that he's fired. Paper is the rule. I have confidence they did right. (well, they put the wet stuff in plastic and when opened for DNA testing, it was sour) Shoes are lost. Photos only.
THEN he goes zany, I spent "hundreds and hundreds of hours" reviewing file to find my memory. I did research about my memory and I typed up research. False memory possible and so I typed notes about my answers to your questions and you can't see the notes. What? Court says turn them over. Pages and pages. Need copies for DA and court. He gets worked up now. "Those are mine and no one should see them." Copies ordered. "I spent hundreds and hundreds of hours reviewing" and trying to remember and "I typed answers to your questions for this testimony" because " who can ever remember after 2 years". Then as the documents are being read and copied Witness blurts "Something funny there?" Court says very pointedly No question pending. (i.e. shut up) He keeps asking what's funny. Then OK he's quiet. Then he blurts again: "You can't have copies." "Mine, my personal notes." " I want them back." (As many times as this Dr. has been an expert, is he used to getting away with using "his personal notes?" Surprise!!
