DIRECT Resident John Goode - a financial officer, bit of a literalist, heard noises. The sounds he heard started faintly. He ignored that for a while then he heard the sounds coming closer. He went to the glass door to look out. The screen on the door obstructed the view but it looked like someone was out there. He opened the door, stepped one foot outside. He saw a "tussle" he thought it might be a dog attack. He could only see one person at first. He called out " What's going on? Stop that. " The men were on the grass on the ground by now and moved while prone and struggling from the grass to the concrete sidewalk. The Man On Top was wearing a "dark" jacket and the man on the bottom was wearing red. The man on the bottom had "lighter skin." The "man on top was straddling the man on the bottom who was face up....pinning him. The man on the bottom was crying for help. It looked like punches were being thrown. There were alternate downward movements of arms of the man on top. Didn't see gun. Didn't see slamming of Zimmerman's head so naturally DA asked in over and over in different ways. Never saw head slamming ? Never heard head slamming? Never heard this and he hits the floor with his hand. A: No
The witness heard the person on the bottom yell "Help." Then the witness says he can't say 100% it was the man on the bottom but accoustically it seemed to be him. (To this witness there are no certainties at all in the world and he added the not 100%) So, he went back indoors and called 911. Heard gunshot while waiting ot be picked up by 911. On the tape we hear him say "I heard a shot. They're wrestleing and the guy's yelling help." Then "I'm pretty sure the guy's dead. Holy Shit." "OMG..." He sees flashlights. "There's a Black guy down and he's dead."
(This is how the DA asks What was the weather like at that time? "What was the weather doing, I mean was it like raining or snowing or clear or what was going on?" Every question is like that and longer.)
Cross Examination:
Noise was faint but getting closer. He got up, muted the TV, looked out the slider. Wife said "Don't go out."........ha ha ha for the jury of ladies. Stepped out for better view, men were on the ground, one an top. W was 20' away. The men wrested in the grass toward the cement. Person on top wearing dark color was now straddling Zimmerman ..... on the cement. Arm movements going downward once they were on the concrete. Now witness thinks "it's serious." "Ground and pound " (MMA) came to his mind... looked like the man on top was dominant and his hands were free. Did not see the man on the bottom fight back.
(Payback for the "man on top" repetition by the Da yesterday is the repetition now by defense of "ground and pound." "During the ground and pound did Zimmerman try to get up?" " During the ground and pound did you see..." )
At first witness could only see one figure. During the struggle, Zimmerman partially "slid out from under" Martin and witness could see him for the first time. But Zimmerman was still pinned down.
States categorically Trayvon Martin was on top and "raining blows" down on Zimmerman who was on the bottom screaming for help.
Witness is shown photo of Martin on the 7-11 security tape and testifies that that clothing Martin is wearing in the store was the same clothing the "man on top" was wearing when the witness saw the fighting. i.e. dark hoodie.
DA table was twitchy during this witness. Zimmerman has been completely level during all the testimony. Very calm demeanor.
Re-direct- tries to defuse ground and pound:
You didn't hear blows. Right? Cops say "ground and pound?" Right? No, I did. DA says "you elaborated,"right? W says "I clarified. " So does that mean you were lying in the beginning and all along? No......
Did you see the man on the bottom trying to get up? Anyone on the bottom would be trying to get up.
Victim's body was face down and Zimmerman was standing up at conclusion of event.
Re-cross Examination:
Your written statement on the very night. Added info-as time went on for clarification but no changes. Initial statement was half page, next one longer , next one even longer ending with 50 page depo. Doesn't mean W was lying by ommision in the first half page statement.
Objection Improper Bolstering....HUH? Overruled, no such objection.
