Trayvon Martin's Phone Records and Text Messages
See, what happened was the State did not turn over all the info extracted from Trayvon Martin's (TM) phone until June 6th. Now with an expert, and a program called Cell-brite (I'm writing what I hear) the defense pulled an additional 600 photos and undisclosed texts about TM looking to buy a hand gun and someone trying to buy one from him, and how he beat a guy in a fight, had been suspended from school for fighting and refusing to quit fighting till he beats this guy who ratted him out and he's not finished yet. Below you can read the blow by blow but at the end, after a 14 hour court day the state's attorney Guy was heard to say that he would give Mr. West exactly one chance to apologize, West begins to yell and the judge jumps up and runs out of the room. She started with Show me what you want to get in through Mr. Connor. I see it in your hand. Gimme it. It was a pile of texts and photos off Trayvon Martin's phone. Several conversations on his phone texts about getting a gun. One issue is authentication. Voice recordings not. Hidden text messages about guns was found in another password protected app, hidden Facebook posts inter alia. Mr. Connor will explain about how only TM could have written these and how they're hidden. Defense says fight issue and gun issue, with photo of hand holding a firearm and Trayvon looking buff.
GUY says inadmissible because these people don't know each other. Speculation about what kind of fight is discussed in texts. Slap fight? Play fight? Specific act evidence inadmissible. Speculation as to what it all means and no context. Response: This is evidence relevant to knowledge of fighting. Not skinny child on was home with his Skittles. (I said that.) MR. RICHARD CONNER: Proffer goes on. Computer forensics. Attorney also. Qualified as expert re extraction in past. Certified by Cell-brite (sic) the software he uses. Bin file from phone received in Feb, data dump from TM's phone. Able to use soft ware to retrieve dumped and hidden data, and he tells how. He looked at report FDLE. made of the contents of phone. He thought there was more non-reported data on TM's phone. Cell-bright reads but bin file is everything in the phone, whether or not it could be parsed. He matched amount of data. He had 600 more pictures than the cops had. Searched for them with software, Cell-brite (sic) Then another report but still no 600 pix. Week before this trial he got another report with some of the pictures. Key word searches against the bin file, looked in data bases, app and content. More photos, one with a gun and a hand holding a gun, taken by TM's phone.
Shown 5 or 6 texts where TM trying to purchase a gun and then someone trying to buy a hand gun. Texts on phone. Some deleted but still on phone. Pictures will stay until deleted. Texts too. So deletes are user initiated. A wrong pass code, app time-outs for a longer and longer time. Default time out feature. Identifiers on texts, inbox or sent, who you sent to or got from, status of message. Text with half brother Quevas Fulton re fire arm. Just before event. With different people too: Qua Fulton, Spoonhead Jack, Jay, Braun, Dario, Diamond (Rachel Jeantel) and Fruit. TM texted he was coming to Sanford on 20 or 21 Feb. Self portrait on phone. Big buff guy. No meta data. So he doesn't know what device took the photo.
About fights, data on phone was in data base not seen by Cell-brite. It was in an application to hide text messages. You need to pull up the app plus code. Mr. Connor can view data base in plain text, he went there and got texts. He had found indication that there was a file but it was not indicated in any report he got from FDLE. He did word search. Two codes required to get to texts, code to unlock phone code, hidden app then code to open app, then txt and be texted. Gun conversation with someone he appeared to have a relationship with. All gun stuff on hidden app. Not deleted. Password protected. All fight stuff in another different hidden app. Password protected.
Log of texts: Lavondria text was about a fight. She writes: WiD? TM: tired and sore, L: me too but what happened ta u. TM: Fight. L: Y? TM: man snitched me out L: Y you always fighting. TM: at school in tucked spot. Lost first round but won second and third. ............ L: You need to stop fighting for real. TM Na, not done...… L: No bey stop. You get suspended again. TM : He not bleed enough
His brother Dimitrius Martin says when you gonna teach me to fight? There were more. Expert saw 8000 texts, all appear to be same person. Cadence and pattern. Texts about drugs and drug use deleted but retrieved. Porno also on phone undeleted. Rachel Jeantel testified she was told TM was in fight. Closes loop on authentication. *******Court has been in session over 13 hours.
Argument : We want it in relevant to TM's aggressive nature and goes to self defense. State: We want it out as prejudicial. It's rank speculation.
Anyone could have sent the messages. Name alone is not authentication. He never says Hey it's Trayvon. Then everyone is yelling and the judge runs out. We're in recess.
